STEP 1: Booking and Cancellation Conditions

All of the required fields must be filled in, the General Terms as well as the Booking and Cancellations Conditions must be accepted, and 25% of the price must be paid to complete the booking.

Booking Payment:

The booking must be paid either with a credit card or within a maximum five days via transfer to the bank account ES20.0081.0113.16.0001429949 (Banco de Sabadell, S.A.)  and a bank transfer confirmation must be sent to the email address info@lloretholiday.es or faxed to +34 972 363105.  Once the bank transfer has been received in our bank account, we will send the booking confirmation.  If after 5 days, no payment has been received, your booking will be automatically cancelled.

Booking Cancellation:

Customers may cancel their booking. If cancelled within a period of till April 1 of the current year of rent, the 50% ( pay  reservation) processing fee and bank transaction costs will be deducted and the rest of the paid amount will be refunded.

If cancelled after April 1 of the current year of rent, the customer will not be refunded any sum at all.

In the implementation of reservation of some properties from 15 June to 30 August must be paid 100% of the price. This condition will be written in the description of the object and the booking confirmation.

STEP 2: General Contract Terms

One: DIAMOND HOUSE-LLORETHOLIDAY, S.L., an estate agent's registered with the corresponding register under the number AICAT4724, with a registered address at C/Camprodon i Arrieta 29, CP17310, and assigned CIF (Spanish business tax ID) B55097257, is acting herein as a representative and by commission of the property owners.  Therefore, its liability is limited to that which is inherent to representation.

Two: The legal relationship formalised herein is that of tourist residence rental which is subject to Spanish Decree 164/2010, of 9 November regulating tourist residences as well as the clauses in this document.  Spanish law on residential town property rental does not apply.

Three: No Admission and Eviction Rights.

On behalf of its clients, DIAMOND HOUSE-LLORETHOLIDAY, S.L. has the right not to admit the customer as well as booking cancellation rights. If the non-admission right is exercised and the guests have not yet been accommodated, the paid amount will be refunded but no compensation of any kind will be due to the Customer.

DIAMOND HOUSE-LLORETHOLIDAY, S.L. has the right to evict guests in the event of negligent behavior that may harm and/or cause disturbances to neighbors or the leased property without the right to a refund of the paid amounts and without prejudice to the owner’s right to possible compensation for damages.

Four: Registration, Contract and Inventory Signing, Deposit and Keys.

Reception is completed at the DIAMOND HOUSE-LLORETHOLIDY, S.L. Office from 4:00 p.m. to 9:00 p.m. If the Customer will be arriving outside said schedule, this must be communicated to DIAMOND HOUSE-LLORETHOLIDAY, S.L. by phone at +34 972 363 105, or email at info@lloretholiday.es in order to establish a different time for registration.

Volgens Koninklijk Besluit 933/2021 is het verplicht om alle gasten van de reservering online te registreren vóór het inchecken. Indien het inchecken niet wordt voltooid, wordt een extra administratieve kost van €10 per persoon in rekening gebracht. Het niet naleven van deze verplichting of het verstrekken van onjuiste gegevens kan bestraft worden. Daarnaast kan bij aankomst de documentatie van alle gasten worden gevraagd om de geregistreerde informatie te verifiëren.

At the time of reception and the customer’s registration, the customer must be identified by a passport or national identity document if he/she is from the European Union.  The non-presentation of the aforementioned documents may be cause for non-admission without any right to a refund of the amount paid by the customer.

When registering, the customer must sign the rental contract with the clauses herein and the property inventory list.  The customer will have a period of 24 hours to verify that said list corresponds to the content of the property.  After that time, it will be understood as accepted.

At that time the customer must pay the rest of the booking fee (75%) and pay a deposit in the amount of sum of Euro, specified in booking confirmation, which will be refunded when the property is vacated as long as it is in the same conditions as it was received and all of these general terms have been fulfilled.

The keys to the property will be handed over to the customer at the DIAMOND HOUSE-LLORETHOLIDAY, S.L. office.

Five: The tourist residence will be delivered clean and equipped with clean sheets and towels.  The customer must leave it in the same conditions and with clean sheets and towels, or, where appropriate, pay the corresponding cleaning fee.

If the customer observes any deficiency or poor conditions in any of the facilities, this must be communicated to the representative by telephone at +34 972 363 105 or at the office located at street Camprodon i Arrieta 29, CP17310

Six: Customer - Tenant Rights and Obligations:

The Customer will have right to stay in and use the rented property and ensuite facilities for the period booked or expressly agreed upon with DIAMOND HOUSE-LLORETHOLIDAY, S.L.

During the stay, the Customer will observe the rules of the owners’ association applicable to the property and respect the neighbors’ nightly rest which is from 10:00 p.m. to 8:00 p.m.  The Customer must treat the property and corresponding facilities, household appliances, furniture and decoration properly; keeping it all in good conditions.  The Customer will be liable for the costs of any repairs for damages caused by him/her in the residence and to the objects within it as well as to any of the shared areas of the property or to the neighbors.  These sums will be deducted from the deposit and, if this is not sufficient, the Customer will be required to provide his/her bank account data (bank account number, IBAN and BIC) to collect the corresponding repair costs.

The release of apartment will take place from 8 am to 10 am on the day of the release, with a possible penalty of 100.00 euros for delays not previously granted with Diamond House-LLORETHOLIDAY, SL

If the customer needs more clean sheets or towels, he/she will have to pay for this service separately.

On the day of departure, the Customer must leave the property clean and fulfil the following conditions:

1.            Leave the crockery and cutlery clean and in their original place;

2.            Empty all household appliances of any objects;

3.            Collect all rubbish from the property and the garden/balcony and deposit it in the        pertinent bins;

4.            Leave the fireplace and grill empty and clean;

5.            Return all furniture in the residence and on the balcony to the original position and     make sure there is no rubbish in the garden and/or on the balcony;

If these cleaning conditions are not fulfilled, DIAMOND HOUSE-LLORETHOLIDAY, S.L. may deduct up to €250.00 from the deposit for cleaning fees.

The release of apartment will take place from 8 am to 10 am on the day of the release, with a possible penalty of 100.00 euros for delays not previously granted with Diamond House-LLORETHOLIDAY, S.L.

Seven: The cost of services such as water, gas, electricity, etc. that may be needed by the customer which are not provided for in these clauses will be charged as per the addendum for each property and will be indicated at the time the booking is confirmed.  If they are not provided for, they shall be paid separately and the sum will be negotiated with DIAMOND HOUSE-LLORETHOLIDAY, S.L. If additional services are needed, the Customer should contact DIAMOND HOUSE-LLORETHOLIDAY, S.L. to confirm their provision, the costs and conditions.

Eight: Maximum Number of Occupants:

The maximum number of occupants will be established in the addendum for each property. Under no circumstance may the Customer exceed the indicated maximum.  This clause is subject a penalty fee of € 1000 per person and day. DIAMOND HOUSE-LLORETHOLIDAY, S.L. reserves the right to immediately evict any person(s) exceeding the occupation limit.

Nine: Data Protection:

Pursuant to the provisions of Spanish Organic Law 15/1999 of 13 December concerning Personal Data Protection, by accepting these General Terms, the Customer hereby agrees to the inclusion of his/her personal data in a file owned by DIAMOND HOUSE-LLORETHOLIDAY, S.L. transmitted to the data holder for the purposes inherent to the proper fulfillment and management of this contract and the deriving rights and obligations. Moreover, the Customer hereby authorizes the transfer of the data to the authorized authorities in the situations provided for by Spanish law. The Customer is hereby informed that DIAMOND HOUSE-LLORETHOLIDAY, S.L. is legally required to notify the Customer’s stay and his/her personal data to the competent authorities.

Ten: The Customer is hereby informed that he/she may get information on his/her rights by reading Spanish Royal Legislative Decree 1/2007, of 16 November, which approves the modified text of the General Consumer and User Defense Act and other complementary laws. 

Eleven: Complaints and Claims.

When registering to use the residence rented for his/her tourism stay, the Customer will be provided with the information of the owner of said residence to whom all possible complaints must be directed related to the conditions of the property facilities or any other incidents that may arise.

Twelve: Jurisdiction.

Any complaints or any other type of disputes shall be subject to the jurisdiction of the corresponding municipal authorities of Lloret del Mar and the province of Gerona.  The parties hereby expressly waive any other jurisdiction that would otherwise apply.

DECIMOTERCERA. Los términos del acuerdo de menores de 18 años Según el reglamento para los menores de 18 años que no requiere de adultos en el grupo

1) El pago debe ser realizado por los padres 
2) El contrato tiene estar firmado por los padres adjuntando siempre fotocopia de pasaporte Permiso 
3) Los padres deben proporcionar por escrito ante notario el permiso apostillado de viajar al extranjero y para el alojamiento de la casa / apartamento.
